MEMORANDUM OF ASSOCIATION
OF
MAULANA AZAD EDUCATION FOUNDATION

The name of the Foundation shall be the MAULANA AZAD EDUCATION  FOUNDATION.

The Registered Office of the Foundation shall remain in the State of Delhi and at present it is at Social Justice Service Centre, Chelmsford Road, New Delhi – 110 055.

OBJECTS:

The Foundation shall be a voluntary, non-political, non-profit making social service organization established to promote education amongst educationally backward sections of society. The aims and objects for which this Foundation is established are:-

  1. to remove educational backwardness, and create awareness about the national ideals of JUSTICE, LIBERTY, EQUALITY AND FRATERNITY AND DEMOCRACY, SECULARISM and SOCIALISM;

  2. to formulate and implement educational schemes and plans for the benefit of the educationally backward minorities in particular and weaker sections in general;

  3. to promote research and encourage other efforts designed to mould educational policies of the STATE for the benefit of the educationally backward minorities;

  4. to establish Chairs in selected Indian and foreign Universities for researches into the life and contributions of Maulana Abul Kalam Azad especially in the context of secularism and pluralism;

  5. to establish residential schools especially for girls in order to provide modern education to educationally backward minorities, preferably in or around, urban, semi urban and rural areas;

  6. to assist and support, and evaluate from time to time the implementation of the National Policy on Education in an effective manner, especially in regard to its provisions relating to the educationally backward minorities;

  7. to provide financial and other aid or consultancy service to institutions/ organizations engaged in the promotion of education among the educationally backward minorities;

  8. to function as a data bank on education and to establish Information and Counselling Centres;

  9. to undertake preparation and publication of materials including journals and other periodicals and preparation and dissemination of material for mass media;

  10. to collaborate with and other Societies/organizations pursuing the objective similar to those of the Foundation;

  11. to arrange for providing coordination and imparting training in the relevant skills and in entrepreneurship to artisans' children and help them in setting up self-employment ventures;

  12. to open, run and assist Libraries and Book Banks;

  13. to create awareness about the problems of the weaker sections especially the educationally backward minorities and to give appropriate advice to Government;

  14. to undertake all such activities as are not specifically mentioned in the aims and 
    objects listed above, but which promote these objectives.

  1. All the incomes, earnings, movable or immovable properties of the Foundation shall be solely utilized and applied towards the promotion of its aims and objects only as set forth in this Memorandum of Association, and no portion thereof shall be paid or transferred directly or indirectly by way of dividends, bonus, profit or in any manner whatsoever to the present or past members of the Foundation or to any person claiming through any one or more the present or past members. No member of the Foundation shall have any personal claim on any movable or immovable properties of the Foundation or make any profit, whatsoever by virtue of his membership.

2. In furtherance of and consistently with these objects, it may;
  1. raise funds from individuals and institutions within and outside the country;

  2. receive grants-in-aid from Government and assistance from the Central Wakf Council and other Wakf institutions;

  3. purchase, take on loans, or exchange, hire, accept as gift or otherwise require any movable or immovable property, or rights therein or privileges attaching thereto which may be necessary or convenient for its objects;

  4. sell, lease, mortgage, let on hire, exchange, or otherwise dispose off all or any portion of its property, rights, assets or liabilities to any other society, Trust, person or persons;

  5. use print and electronic media to disseminate necessary information;

  6. receive moneys due to it and invest its funds and moneys in securities or property or in any other form and to operate its accounts with any scheduled bank or approved financial institution upon such terms and conditions and in such manner as may be determined from time to time.

  7. borrow or raise money, if necessary by mortgaging or charging the whole or any part of its property assets or rights, on such terms and conditions and in such manner as may be determined from time to time.

  8. do all such other acts whether incidental to the powers aforesaid or not, as may be required to further its objects.

3. THE GOVERNING BODY:

The management of the Foundation shall rest with the Governing Body of the Foundation. The names, address and occupations of the person who are present members of the Foundation's Governing Body and to whom the Foundation entrusts the management of its affairs in accordance with its rules and regulations and section 2 of the Societies Registration Act, 1969, as applicable to the Delhi State, are as follows:-
